Texas: Capacity Without a Constitution

The largest pipeline in America, a brand-new interconnection regime, a governor turning against incentives, and the first Clean Air Act test case: Texas is writing its rules mid-boom

Texas carries the largest data center pipeline in the country at 962 sites, with roughly 6.5 GW under active development and a credible path to overtaking Virginia as the largest market by 2030. It also hosts the fullest expression of every trend in the Atlas: gigawatt leases (Beacon Point's $19.6 billion), dedicated generation (Chevron and Microsoft at Pecos), a semiconductor corridor absorbing more than $100 billion, and now the nation's first Clean Air Act enforcement campaign against off-grid campuses. Texas has the capacity. What it is building, in real time, is the constitution.

Capitol: Batch Zero Rewrites the Queue

The structural policy event of 2026 is ERCOT's PGRR145, the Batch Zero framework that replaces utility-by-utility studies of large loads with an ERCOT-led, systemwide batch process for interconnection requests of 75 MW and above. Requests are sorted by maturity and commitment into base load, studied load, or deferred load; ERCOT runs a systemwide interconnection study and a refinement study identifying transmission needs and costs; and successful applicants get 30 days to execute agreements after receiving six-year megawatt allocations. The final Batch Zero report is due June 1, 2027. For developers, the trade is explicit: less first-mover queue arbitrage, more certainty and speed for committed projects. It is the most consequential redesign of large-load interconnection in any U.S. market, and other regions are already studying it.

Capitol: Abbott Turns the Page on Courtship

The political weather changed this year. With the legislature out of session until 2027, Governor Abbott routed his agenda through the Public Utility Commission: requirements that data centers pay their own electric infrastructure costs, use water-efficient cooling, add generation capacity rather than merely consuming it, and meet siting and setback standards. He has also pledged to work with the 2027 legislature to repeal sales tax exemptions and what he called outdated incentives for data centers. Meanwhile the courts opened a second front: on July 22, the Environmental Integrity Project, Sierra Club, and Public Citizen filed a 60-day Clean Air Act notice against Vantage and VoltaGrid over two off-grid San Antonio campuses running 423 MW of gas plants and 151 diesel generators on minor-source permits. Texas permitting speed built the behind-the-meter boom; Texas litigation may now define its limits nationally.

Capacity: The Full Stack in One State

No state hosts more of the AI supply chain end to end. Compute: Stargate's flagship at Abilene, Hut 8's fully commercialized 1 GW Beacon Point in Nueces County (base-term value $19.6 billion, up to $50.2 billion with renewals, on a 1,000 MW AEP Texas interconnection), and the Dallas-Fort Worth and Austin-San Antonio metros both ranked among national leaders. Power: the Chevron-Microsoft 20-year dedicated-generation agreement near Pecos, one of the largest compute-generation pairings in the country, plus the deepest merchant storage market in America under ERCOT's energy-only design. Semiconductors: Samsung Taylor, Texas Instruments' $40 billion Sherman program with its first fab opening this year, and the announced $20-25 billion Tesla/SpaceX/xAI Terafab making the Austin-Taylor corridor the most consequential new chip geography in the United States. The DOE draft study confirms what the pipeline implies, naming Texas alongside Virginia for the nation's highest current data center demand and largest projected increases, with ERCOT unique among grid operators in citing demand growth, not reliability, as its primary transmission driver.

Signals: What the Distress Monitor Shows

The stress points are physical and legal, not financial. Summer scarcity remains structural; the July heat events again pushed operators onto backup generation at ERCOT's request. The Vantage/VoltaGrid notice puts re-permitting risk over every minor-source gas fleet in the state, and an adverse ruling in the Western District of Texas would cascade through the entire off-grid model. And the Batch Zero transition itself is a schedule risk: projects that assumed old-regime timelines must now clear a systemwide study gate, and the deferred-load category will produce visible losers by mid-2027. Against that, the demand signals are the strongest in the nation, and the tenant credit backing Texas leases (investment-grade counterparties across Hut 8's 949 contracted MW) is the best in the sector.

Atlas Rating: Constrained, Trending Balanced

Texas rates Constrained because the grid process, the permitting fights, and summer scarcity all bind today, but it trends Balanced because Texas is the only state in the top tier adding generation, transmission process, and manufacturing capacity at a pace comparable to its demand. The 2027 session is the swing variable: if Abbott's incentive repeal and cost-responsibility agenda passes intact alongside a functioning Batch Zero, Texas becomes the first major market with a complete, if stricter, rulebook. Capacity was never the question here. The constitution is, and it is being drafted now.
